Please read these Terms and Conditions (‘Terms’) carefully before using www.ttlglearn.com (‘the Website’).

Part A applies to all users of the Website
Part B applies if you enrol for a Through The Looking Glass Learning Capsule (’Learning Capsule’)

Part A

1. Terms applying to all users of the website

In these terms, ‘we’, ‘us’ and ‘Through The Looking Glass’ (‘TTLG’) means:

which is the owner of this website and the TTLG brand, and ‘you’ means the user of this Website.

You acknowledge that you are responsible for making back-up copies of all of your data and taking appropriate risks against viruses and other types of computer misuse.

Whilst we try to ensure that the Website does not contain any error, defect, malfunction or corruption, we do not accept responsibility for any damage to, or loss of data on your computer system, network or server that results from the download or use of the Website or any materials made available via the Website.

We cannot promise that access to the Website will be uninterrupted or error free. We reserve the right to suspend access to the Website for emergency maintenance or to carry out upgrades to improve the performance, functionality or content. Access may also be interrupted due to failures of telecommunications links and equipment, which are beyond the control of TTLG.

You accept that you will not have a claim for breach of contract (either against us or a nominated TTLG partner) or otherwise in respect of such a period of unavailability. You also acknowledge that we cannot be held responsible for any delay or disruptions inherent in the operation of the internet, including viruses.

We shall not be liable to you for any of the following types of loss or damage arising out of or in connection with your use of the Website or any content provided via the Website:

  • Any loss of profits, loss of earnings, loss of anticipated savings, goodwill or revenue;
  • Any loss or corruption of data; or,
  • Any indirect or consequential loss.

Each provision of this Paragraph or Terms shall be construed separately as between you and us. If any part is held to be unreasonable, inapplicable or unenforceable, then the other parts shall still apply.

The receipt of services rendered by TTLG or a TTLG nominated partner is personal to you and you may not transfer your rights of access to Course Materials, or to receive the services to another person unless we have consented in writing to you doing so.

If either we or you fail to enforce, or delay in enforcing, any of our respective rights or remedies under these Terms, such failure or delay shall not operate as an agreement to waive that right or remedy, and shall not prevent us from exercising that right or remedy in the future.

These Terms are governed by and shall be construed in accordance with Canadian law. Any dispute arising between us under, or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the Canadian courts.

2. Purpose of the Website

The purpose of the Website is to provide individuals and businesses with the following:

  • Information on the range of courses and consulting services offered by TTLG or TTLG nominated partners.
  • Information on and views about the airline industry by way of the AIReflections podcast (the ‘podcast’)
3. Third-party links

We may provide links to third-party websites. These may include links to sites owned by nominated partners of TTLG. Any link is provided for your convenience only, to be accessed at our own risk. We are not responsible in any way for the content of any third-party website, or for goods or services provided by the operators of such websites. If you choose to use any of the links provided, you should ask for access to the terms and conditions of the third-party website. TTLG does not accept any liability whatsoever (including but not limited to any loss, damage, expense, costs) incurred by you in respect of these third-party websites.

4. Amendments to the Terms

We reserve the right to amend these Terms from time to time. When we make a change we will update this page of the Website. If we do so, the updated version will be effective as soon as it is uploaded onto this Website. The date of the last revision to these Terms is provided at the end of the Terms. It is your responsibility to appraise yourself of these Terms and revisions. If you continue to use the Website you will be deemed to have accepted those changes from the point at which those changes came into effect.

Part B

5. Terms applying if you enrol for a TTLG Learning Capsule

In these Terms,

  • ‘we’ and ‘us’ means TTLG or a TTLG nominated partner who will provide services to you.
  • The ‘Provider’ means the entity actually providing the services. The Provider is identified as the entity to which you pay a fee.
  • ‘you’ means the learner or organisation receiving the services.
  • ‘enrol’ means the process of enrolling for a Learning Capsule and the term ‘enrolment’ shall be construed accordingly.
  • ‘Services’ means (i) the provision of the Course Materials in electronic format via the Website or the Adobe Connect Pro website; (ii) Course Materials provided in paper or other format where that option applies; and (iii) the provision of tutorial or other support.
  • ‘Course Materials’ means the materials required to complete the Learning Capsule.
  • ‘Learning Capsule’ means a course of study made available either via the Website or the Adobe Connect Pro website. The Learning Capsule may be available either in synchronous form, (whereby transmission is conducted ‘live’ in real time), or asynchronous form (where access is made to pre-recorded material).
  • ‘Course Fee’ means the fee payable for the provision of Services.
6. Password

When you enrol for a Learning Capsule you will be asked to pay a fee. Upon receipt of that fee you will be issued with a user name and password to enable access to Course Materials on the Adobe Connect Pro website. You will be responsible for all activities that occur under your user name and password. You should take care to keep your user name and password confidential. You must notify us immediately of any unauthorised use of your user name or password, or if you believe that your user name or password are no longer confidential. We reserve the right to issue you with a revised user name or password if we believe that they are no longer secure.

7. Personal information

We collect personal information when you enrol as a learner. Depending on the preferences indicated by you, we may use your personal data to contact you about TTLG news and offers. You can request that your details not be used for TTLG marketing purposes.

When you enrol with us, you (or the person enrolling you) must tell us:

Your full name
Your gender
Your date of birth
Your address (and correspondence address, if different)
Your email address
Primary telephone number
Where you heard about us

Following enrolment via the Website, we, or a TTLG nominated partner, may request additional information from you in order to support your learning. You do not have to provide this information, but if you choose not to, you may not get the most out of your learning.

Please note that if you are enrolled on a programme of learning that enables you to gain credits to be applied towards a qualification awarded by a third-party organisation, then the Terms and Conditions of that organisation shall be applied concerning the provision of personal information.

Before you start your learning activities, TTLG or a TTLG nominated partner shall provide you with a unique Learner Number.

We collect information about how you use Course Materials to monitor your learning to help us improve users’ learning experience.

TTLG may need to share information with a TTLG nominated partner. If this is the case, when you enrol on a course we will tell you which partner will be delivering and supporting your learning.

If you have not registered as a learner but are simply making an enquiry or request for information, we will use your personal information to reply to your enquiry or request. We will not use this information for marketing purposes without your permission or unless you invite us to do so.

Even though we take appropriate technical steps to protect your security, you should remember that data transmission over the internet cannot be guaranteed to be 100% secure, so you should use the internet at your own risk.

8. Provision of services

Once you enrol on a TTLG Learning Capsule you shall be issued with a unique Learner Number which will be used for the duration of your relationship with TTLG.

When the course fee has been paid you shall be issued with a user name and password to enable you to access the Adobe Connect Pro site which hosts the appropriate TTLG Learning Capsule. If you have enrolled on more than one Learning Capsule, you will be issued with different passwords for each Capsule.

You may log onto Adobe Connect Pro from any computer equipped with a web browser and Flash Player by using your assigned user name and password. You should note that audio settings differ from computer to computer and you should follow the online instructions to ensure that the audio transmission is working. For synchronous (real time) Learning Capsules, learners have the choice of either internet audio or connecting via an audio conference bridge.

TTLG or TTLG nominated partners shall not be liable for interruptions to telecommunications links. Adobe Connect Pro offers technical assistance, and TTLG undertakes to use its best endeavours to resolve any technical difficulties with Adobe on your behalf. You accept that you will not have a claim for breach of contract (either against TTLG or a TTLG nominated partner) or otherwise in respect of unavailability of IT infrastructure.

If the Learning Module allows you access to Course Materials you shall be provided with instructions to download that material.

TTLG offers additional individual coaching and tutorials via Adobe Connect Pro for certain Learning Capsules. These are identified as the ‘1-2-1 programme’. The precise format for 1-2-1 sessions is subject to individual agreements with the learner.

9. Cancellation

If you have enrolled on a Learning Capsule and decide to cancel, you may do so provided that:

  • You notify TTLG, or the TTLG nominated partner as appropriate. In the event of a live programme this notification must be made at least 24 hours before broadcast.
  • You have not accessed any relevant Course Materials or obtained tutorial support.

In the event of cancellation where the above conditions are met, a full refund will be provided.

10.Quality of service

We will use reasonable skill and care in the execution of our services by adhering to the Learning Capsule description. We will use reasonable endeavours to ensure access to the Website but reserve the right to interrupt access in order to perform updates or maintenance. Access may also be interrupted due to failures of telecommunications links and equipment beyond the control of TTLG.

We make no undertaking or commitment that the content of the Learning Capsules will meet any specific requirements that you have (except to the extent that your requirements match the description of the Learning Capsule on the Website). We expect you to take reasonable steps to ensure that the Capsule in question meets your needs. We do not make any commitment that you will obtain any particular result from the receipt of services or attain any particular qualification.

Additional charges may be payable to third parties for use of software necessary to view and download certain Course Materials. You are responsible for paying these charges.

If you are an online learner, we will make Course Materials available to you via the Website from the enrolment until the earlier of:

  • Your notifying us in writing, by email or by telephone that you have completed the course and no longer require access to the Course Material;
  • Your failing to access the Course Materials for a period of 180 days or more; or
  • 90 days after TTLG or a TTLG nominated partner marks the course as completed or achieved.

On occurrence of the earlier of the events mentioned above, we will suspend your access to the Course Materials. If you wish to subscribe for services after your access to Course Materials has been terminated, you will need to enrol again.

We reserve the right to stop providing services to you immediately in the event that:

  • You fail to comply with paragraph 11 of these Terms which deals with the manner in which you are permitted to use the Course Materials and the Website; or
  • You fail to conduct yourself in an appropriate manner when communicating with or receiving support from us.

If we exercise this right we will notify you via email or your chosen medium. We will then suspend your access to the Course Materials. No refund of Course Fees is payable if we stop providing services in the above-mentioned cases.

10. Liabilities

The exclusions and limitations of liability contained in these Terms do not apply to:

  • Any loss or damage resulting from death or personal injury caused by our negligence;
  • Loss or damages arising from our fraudulent misrepresentation; or
  • Any other losses which may not be excluded or limited by law.

We shall not be responsible to you in the event that we cannot provide services to you due to an event beyond our reasonable control, which includes (but is not limited to) events such as fire, flood, storm, strikes or other industrial action, the actions of any government or public body, failure of telecommunications services, war, riot, or alien abduction. In the event that we are prevented from providing the services by such an event, we will take all reasonable steps to try to reinstate the provision of the services to you as soon as is reasonably practical.

We are not responsible to you for any data that you lose either (a) as a result of accessing the Course Materials; or (b) during completion of any Learning Module via the Website, or the website of Adobe Connect Pro. It is your responsibility to ensure that you regularly save and back up your data.

Except where the above applies, our maximum aggregate liability to you for any claim that you may have against us shall be limited to the amount of the Course Fee which has been paid, or is payable by you.

Each provision of this paragraph shall be construed separately as between you and us. If any part is held by a court to be unreasonable, inapplicable or unenforceable, then the other parts shall still apply.

11. Your right to use the Course Materials and your related obligations

In consideration of receipt by us of the Course Fee, we grant to you a non-exclusive, non-transferable licence (ie not to be used by, or transferred to, another person) for you to use the Course Materials for the sole purpose of non-commercial use in connection with the receipt of the services. As such, you may make copies of the Course Materials as they appear on the Website as necessary incidental acts during your viewing of it, and you may print for your personal use as many pages of the Course Materials on the Website as are reasonable for private purposes. You may not make copies of any Course Materials supplied to you in hard copy format.

Save as expressly set out in these Terms, you may not modify, copy, reproduce, re-publish, upload, post, transmit or distribute in any way the Course Materials. Any use of the Course Materials not expressly permitted in these Terms is strictly prohibited and will constitute an infringement of either our copyright or our other intellectual property rights, and/or the copyright or other intellectual property rights of our licensors.

12. General

Subject of the terms of any agreement we conclude with you if you enrol on a TTLG Learning Module, we reserve the right to withdraw all or part of the Website at any time.

These Terms are governed by and shall be construed in accordance with Canadian law. Any dispute arising between us or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the Canadian courts.
